1. Agreement Overview
These Terms & Conditions (“Agreement”) govern your participation in the Swim Hair Affiliate Program (“Program”) offered at https://swimhair‑affiliateprogram.com (“Site”) by Swim Hair, LLC (“Company,” “we,” or “us”). By applying to or continuing participation in the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by this Agreement.
2. Definitions
- Affiliate Link: A unique URL or code provided to you for tracking referrals.
- Commissionable Sale: A sale that originates from an Affiliate Link, is paid in full, and is not later canceled or refunded.
- Dashboard: Your private Affiliate account area where links, reports, and payouts are managed.
3. Enrollment & Eligibility
- Application: Complete the online application and, if applicable, pay a one‑time registration fee.
- Approval: We may approve or deny applications at our discretion.
- Requirements: You must be at least 18 years old, comply with all laws, provide valid identifying information (including a working email address), and maintain a legitimate marketing channel (website, blog, social‑media page, etc.).
4. Commission Structure & Payments
- Commission Rates:
- Basic (Free): 5% per qualifying product sold
- Plus ($19.99 fee): 10% per qualifying product sold
- Elite (Tier Bonus): 15% once you reach 100 total referred sales
- Distributor Royalty: A $3 royalty per unit sold is paid to our distributor before calculating your commission.
- Payout Cycle: Monthly payouts within 15 days after month‑end, subject to a $50 minimum balance.
- Payment Methods: PayPal or direct deposit, as elected in your Dashboard.
5. Fraud Prevention & Audit Rights
5.1 Block Self‑Referrals & Fake Sign‑Ups
- IP Address Tracking: Prevent multiple sign‑ups from the same device or network.
- One Account Per Payment Method.
- Verification for Higher Tiers via government-issued ID or Form W‑9.
5.2 Prevent Fake Sales & Bonus Exploits
- Commission Holding Period: 30–60 days.
- Bulk Order Review: 10+ units.
- Minimum Sales Timeframe for tier upgrades.
5.3 Monitor for Suspicious Activity
- Unusual Referral Patterns.
- Household Limit: 2 Affiliate accounts.
- Random Account Audits monthly.
We reserve the right to withhold or claw back commissions from fraudulent activity.
6. Refund Policy
- Product Returns: 30-day refund policy; commissions reversed on returns.
- Membership Fee Refunds: Non-refundable unless requested within 48 hours and no usage.
- Abuse of Refunds: Leads to account termination and clawback.
7. Affiliate Responsibilities
- Use Company materials only.
- Follow legal guidelines (FTC, CAN-SPAM, etc.).
- Do not misstate product info.
8. Intellectual Property
Limited license to use Company trademarks and promotional assets solely for Program participation.
9. Confidentiality
Keep non-public Program info confidential and use it only for Program-related activities.
10. Term & Termination
- Term: Active until terminated.
- By Company: Immediate termination for fraud or at-will.
- By Affiliate: Opt-out anytime via Dashboard or in writing.
- Effect: Stop using Affiliate Links and branding; pending payments processed unless under investigation.
11. Indemnification
You agree to defend and hold harmless the Company against any claims from breach or promotional actions.
12. Limitation of Liability
Company’s liability is limited to commissions paid in the past 12 months. No consequential damages.
13. Dispute Resolution & Governing Law
- Law: Indiana.
- Venue: Marion County, Indiana.
- Arbitration: At Company’s election via AAA rules.

- Terms may be updated at any time via the Site.
- This Agreement represents the full understanding between you and the Company.

By registering for or participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
